This diaper tax can be as low as 4% or as high as 7% (Mississippi and Tennessee). In many states, cities and counties can add additional tax.<\/p>\n<p>Children require at least 50 diaper changes per week or 200 diaper changes per month. This bill was officially signed by the Governor on July 10th, 2025 and goes into effect August 28, 2025.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>2023<\/h2>\n<p><a href=\"https:\/\/www.ndlegis.gov\/assembly\/68-2023\/regular\/documents\/23-0448-02000.pdf\" target=\"_blank\" rel=\"noopener\">North Dakota<\/a> &#8211; North Dakota exempted diapers in May 2023. It went into effect July 1, 2023.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=88R&amp;Bill=SB379\" target=\"_blank\" rel=\"noopener\">Texas<\/a> &#8211; Texas passed a bill to eliminate the tax on diapers, period products and other basic necessities in June 2023. The bill will go into effect on September 1, 2023.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/www.leg.state.nv.us\/App\/NELIS\/REL\/82nd2023\/Bill\/10437\/Text\" target=\"_blank\" rel=\"noopener\">Nevada<\/a> &#8211; In June 2023, Nevada legislature passed a bill to exempt diapers from sales tax. The bill became a ballot measure during the November 2024 election, 68.2% of voters voted to exempt diapers from sales tax successfully passing the ballot initiative. The diaper tax officially ended January 1, 2025.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.22.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/search-prod.lis.state.oh.us\/solarapi\/v1\/general_assembly_135\/bills\/hb33\/EN\/06\/hb33_06_EN?format=pdf\" target=\"_blank\" rel=\"noopener\">Ohio<\/a> &#8211; Starting October 1, 2023, diapers are tax free in Ohio.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>2022<\/h2>\n<p><a href=\"https:\/\/mgaleg.maryland.gov\/2022RS\/fnotes\/bil_0002\/hb0282.pdf\" target=\"_blank\" rel=\"noopener\">Maryland<\/a> &#8211; Maryland exempted diapers in May 2022. It went into effect July 1, 2022.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2023\/7063\" target=\"_blank\" rel=\"noopener\">Florida<\/a> &#8211; Florida passed <a href=\"https:\/\/www.myfloridahouse.gov\/Sections\/Documents\/loaddoc.aspx?FileName=_h7071er.docx&amp;DocumentType=Bill&amp;BillNumber=7071&amp;Session=2022\" target=\"_blank\" rel=\"noopener\">a bill<\/a> to create a one year sales tax holiday for diapers and other basic necessities between July 1, 2022 and June 30, 2023. In May of 2023, they voted to make the sales tax relief permanent.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/leg.colorado.gov\/bills\/hb22-1055\" target=\"_blank\" rel=\"noopener\">Colorado<\/a> &#8211; Colorado passed a bill to end the diaper tax in June 2022. The bill went into effect on August 10, 2022.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=89&amp;ba=SF2367\" target=\"_blank\" rel=\"noopener\">Iowa<\/a> &#8211;\u00a0 In June 2022, Iowa exempted diapers from sales tax. The bill went into effect January 1, 2023.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?222+sum+HB90S\" target=\"_blank\" rel=\"noopener\">Virginia<\/a> \u2013 In 2019, Virginia classified diapers as necessities similar to food and dropped the tax rate to 1.5% instead of 7%. In July 2022, they removed the sales tax on essentials. The bill went into effect on January 1, 2023.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/iga.in.gov\/legislative\/2022ss1\/bills\/senate\/2\/#document-dd2adde5\" target=\"_blank\" rel=\"noopener\">Indiana<\/a> \u2013 Indiana passed a sales tax exemption and it went into effect July 1, 2022.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>2021<\/h2>\n<p><a href=\"http:\/\/www.legis.la.gov\/Legis\/ViewDocument.aspx?d=1234653\" target=\"_blank\" rel=\"noopener\">Louisiana<\/a> &#8211; Louisiana Governor John Bel Edwards signed a bill making diapers tax free in June 2021. The bill went into effect July 1, 2022.[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><strong>2019<\/strong><\/h3>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB150\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\">&#8211; California initially exempted diapers from sales tax for 2 years <\/span><a href=\"https:\/\/www.cdtfa.ca.gov\/formspubs\/L695.pdf\"><span style=\"font-weight: 400;\">beginning in 2020<\/span><\/a><span style=\"font-weight: 400;\">. Through the Budget Act of 2021 California officially exempted diapers from sales tax for good and the bill took effect immediately in July 2021. <\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><strong>2016<\/strong><\/h3>\n<p><a href=\"https:\/\/www.cga.ct.gov\/2016\/ACT\/pa\/2016PA-00003-R00SB-00502SS1-PA.htm\"><span style=\"font-weight: 400;\">Connecticut<\/span><\/a><span style=\"font-weight: 400;\">&#8211; Diapers became exempt from sales tax in 2016 through a large revenue bill that exempted both diapers and period products, and became effective July 1, 2018. <\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><strong>2013<\/strong><\/h3>\n<p><a href=\"https:\/\/www.mass.gov\/guides\/sales-and-use-tax\">Massachusetts<\/a>&#8211; In 2013, Massachusetts Surgeon General reclassified diapers as medical devices making them tax free.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><strong>2006<\/strong><\/h3>\n<p><a href=\"https:\/\/www.tax.ny.gov\/pdf\/memos\/sales\/m06_6s.pdf\" target=\"_blank\" rel=\"noopener\">New York<\/a> &#8211; New York exempted diapers from state sales tax April 1, 2006. In July 2022, New York exempted diapers from local taxes too. <span style=\"font-weight: 400;\">In 2022, the legislature, through <\/span><a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2021\/S8033A\"><span style=\"font-weight: 400;\">Senate Bill 8033<\/span><\/a><span style=\"font-weight: 400;\">, decided to work to exempt diapers from local sales tax to ensure families are paying no taxes on diapers in New York and that bill was signed on July 19, 2022, making diapers exempt from all sales taxes effective.<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.17.6&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><strong>1991<\/strong><\/h3>\n<p><a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pabull?file=\/secure\/pabulletin\/data\/vol28\/28-24\/932.html\" target=\"_blank\" rel=\"noopener\">Pennsylvania<\/a> &#8211; Pennsylvania has not taxed diaper since 1991. They fall under &#8216;paper goods&#8217; in the state tax code and are not taxed similar to toilet paper, period products and other material basic necessities.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>1989<\/h2>\n<p><a href=\"https:\/\/dspace.njstatelib.org\/xmlui\/bitstream\/handle\/10929\/25490\/t2351989.pdf?sequence=1\">New Jersey<\/a>&#8211; New Jersey exempted diapers 40 years ago through the New Jersey Sales Tax Shopper\u2019s Guide for Grocery, Drugs, and Household Items.
