States can address these issues by enacting new legislation and policies. This diaper tax ranges from a low of 4% to a high of 7% in Mississippi and Tennessee. In addition, many cities and counties impose an additional sales tax on diapers.<\/p>\n<p><span style=\"font-weight: 400;\">Children require at least 50 diaper changes per week or 200 diaper changes per month. By ending the sales tax, families can buy 2 additional diapers for every percentage point reduction in the sales tax for the same money they would have used to buy 200 diapers with tax. <a href=\"https:\/\/nationaldiaperbanknetwork.org\/diaper-tax\/\">Learn more about the diaper tax.<\/a><\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h3><b>Investments in Diaper Banks<\/b><\/h3>\n<p>States may decide to support diaper banks or other organizations by investing state funding to expand diaper distribution programs. This type of investment can be achieved in several ways:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">as a line item in the budget;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">through the action of a state agency; or\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">By passing legislation specifying that the state will provide funding to the diaper bank.<\/span><span style=\"font-weight: 400;\"><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Currently, 11 states and the District of Columbia invest in\/provide funding for diaper distribution programs.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260AB102\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; $7.4 million for 2025-2026; previously $9 million for the 2024-2025 and $30 million for 2022-2024<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/documents\/2025A\/bills\/2025a_hum_act.pdf\"><span style=\"font-weight: 400;\">Colorado<\/span><\/a> <span style=\"font-weight: 400;\">&#8211; $1.5 million for 2025-2026; and previously $2 million for 2024-2025<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/cga.ct.gov\/2025\/TOB\/H\/PDF\/2025HB-07287-R00-HB.PDF\"><span style=\"font-weight: 400;\">Connecticut <\/span><\/a><span style=\"font-weight: 400;\">&#8211; $1.05 million for the Diaper Bank of Connecticut through the Community Resources Funds and Department of Social Services for 2025-2027 <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/titles\/4\/chapters\/4A\">District of Columbia<\/a> &#8211; $500,000 in grant funds towards the investment in diaper banks<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indiana* &#8211; $4 million in TANF funds for 2025-2027<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><a href=\"https:\/\/malegislature.gov\/Bills\/194\/H4240\">Massachusetts<\/a> &#8211; $25,000 for It Takes a Village; $25,000 for Marie\u2019s Mission; $50,000 Neighbors in Need; $200,000 for Cradles to Crayons\u00a0 for 2025-2026<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.michigan.gov\/budget\/-\/media\/Project\/Websites\/budget\/Fiscal\/Final-Signed-Budget-Bills\/FY26-General-Omnibus-HB-4706-PA-22-of-2025-Includes-2025-Supplemental-Funding.pdf\" style=\"font-size: 17px;\">Michigan<\/a><span style=\"font-size: 17px;\">&#8211; $6.4 million in TANF Revenue between 2022-2030<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/mn.gov\/mmb-stat\/documents\/budget\/2026-27-biennial-budget-books\/governors-revised-march\/children-youth-and-families.pdf\"><span style=\"font-weight: 400;\">Minnesota <\/span><\/a><span style=\"font-weight: 400;\">&#8211; $1.106 million for the Diaper Bank of Minnesota for 2026-2027<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/nyassembly.gov\/2025budget\/bills2025\/enacted\/A3003D.pdf\"><span style=\"font-weight: 400;\">New York <\/span><\/a><span style=\"font-weight: 400;\">&#8211; $1.5 million for 2025-2026<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/finance\/budget\/documents\/overviewspresentations\/26%20Admin%20Amend%20Overview%20-%20Final.pdf\"><span style=\"font-weight: 400;\">Tennessee<\/span><\/a><span style=\"font-weight: 400;\">&#8211; $1.0 million for diaper distribution through Nashville Diaper Connection for 2025-2026<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><a href=\"https:\/\/le.utah.gov\/interim\/2025\/pdf\/00002275.pdf\" target=\"_blank\" rel=\"noopener\">Utah<\/a> &#8211; $500,000 to Little Lambs Foundation for Kids from the Department of Health and Human Services for capital improvements<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2025-26\/Pdf\/Bills\/Senate%20Passed%20Legislature\/5167-S.PL.pdf?q=20250514093302\"><span style=\"font-weight: 400;\">Washington<\/span><\/a> <span style=\"font-weight: 400;\">&#8211; $2.5 million for 2026-2027, and previously $10 million for 2021-2025<\/span>\n<ul><\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The following states previously invested in community-based diaper banks, but funding has not been reauthorized and\/or allowed to expire or run out. Advocates in these states are actively working to renew funding to address diaper need in their respective states.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arizona* &#8211; $200,000 (2022-2023)<\/span><\/li>\n<li><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.myfloridahouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=80440#:~:text=HB%205001%20(2024)%20%2D%20General,Act%20%7C%20Florida%20House%20of%20Representatives\">Florida<\/a> &#8211; $50,000 for the Miami Diaper Bank\u2019s Mobile Diaper Pantry Program for 2024-2025<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Georgia* &#8211; $1.227 million in TANF funds (2021-2022)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hawaii* &#8211; $100,000 for the Aloha Diaper Bank<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nevada* &#8211; $327,000 in ARPA and TANF funds (2021-2022)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/pub.njleg.state.nj.us\/Bills\/2024\/AL24\/22_.PDF\"><span style=\"font-weight: 400;\">New Jersey<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; $250,000 for HomeFront NJ to expand their Diaper Access Expansion Pilot Program for 2024-2025<\/span><span style=\"font-weight: 400;\"><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/legislature.vermont.gov\/Documents\/2022\/Docs\/ACTS\/ACT074\/ACT074%20As%20Enacted.pdf\"><span style=\"font-weight: 400;\">Vermont<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; $132,000 in COVID-19 Emergency Funds (2022) and $100,000 to 15 parent-child centers (2023-2024)<\/span><span style=\"font-weight: 400;\"><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">*States that do not invest state funding explicitly in a budget or legislation are not linked.\u00a0<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.26.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><b>Direct Assistance to Families\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">States can make diapers more affordable and available to families in need by providing direct assistance. This may come in the form of a voucher for diapers, an additional allowance for families as part of a work support program, or distributing diapers directly, through a diaper bank or other diaper distribution program. Such efforts are generally very targeted, in part because of limited state budgets. Currently, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB480\"><span style=\"font-weight: 400;\">California<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2021-22\/Pdf\/Bills\/Session%20Laws\/Senate\/5838-S.SL.pdf\"><span style=\"font-weight: 400;\">Washington<\/span><\/a><span style=\"font-weight: 400;\"> provide direct assistance to families. In addition, in July 2024, <a href=\"https:\/\/pub.njleg.state.nj.us\/Bills\/2024\/A2500\/2027_R1.PDF\" target=\"_blank\" rel=\"noopener\">New Jersey<\/a> passed legislation to establish a one year pilot program to provide direct assistance to Work First New Jersey participants.\u00a0<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><b>TANF Family Caps<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Temporary Assistance for Needy Families (TANF) program is designed to help low-income families with children achieve economic self-sufficiency. States receive block grants to design and operate programs that accomplish one of the <\/span><a href=\"https:\/\/www.acf.hhs.gov\/ofa\/programs\/tanf\/about\"><span style=\"font-weight: 400;\">four broad purposes of the TANF program<\/span><\/a><span style=\"font-weight: 400;\">. Such policies vary by state. In addition, efforts are being made to cover diapers under Medicaid for children during diapering years as a way to reduce instances of adverse medical conditions, such as urinary tract infections and diaper dermatitis, that come from not changing soiled diapers for long periods of time, often due to diaper need.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In May of 2024, Tennessee became the first U.S. state to officially cover diapers through the state\u2019s Medicaid program, TennCare. In May 2024, the Centers for Medicare &amp; Medicaid Services (CMS)<\/span><a href=\"https:\/\/www.medicaid.gov\/medicaid\/section-1115-demonstrations\/downloads\/tn-tenncare-iii-demo-aprvl-amndmnt-5.pdf\"><span style=\"font-weight: 400;\"> approved Tennessee\u2019s proposed amendment<\/span><\/a><span style=\"font-weight: 400;\"> to its \u201cTennCare III\u201d demonstration project. This amendment allows the state to provide 100 diapers per month to all children under the age of two enrolled in TennCare or Children\u2019s Health Insurance Program (CHIP).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also in May 2024, CMS approved a <\/span><a href=\"https:\/\/www.medicaid.gov\/medicaid\/section-1115-demonstrations\/downloads\/de-dshp-dmntn-appvl-05172024.pdf\"><span style=\"font-weight: 400;\">diaper benefit<\/span><\/a><span style=\"font-weight: 400;\"> in Delaware, through the \u201cDiamond State Health Plan\u201d 1115 demonstration. The initiative allows Delaware to provide up to 80 diapers and up to one pack of baby wipes per week to mothers in the first 12 weeks postpartum. This approval extends and expands the <\/span><a href=\"https:\/\/www.medicaid.gov\/medicaid\/section-1115-demonstrations\/downloads\/de-dshp-pa-12282022.pdf#page=14\"><span style=\"font-weight: 400;\">\u201cPostpartum Nutrition Supports Initiative\u201d pilot<\/span><\/a><span style=\"font-weight: 400;\"> which is an existing state-funded pilot program that provides home-delivered meals or food boxes up to eight weeks postpartum.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.24.3&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3><b>Tax Credits and Deductions\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">States can support diaper banks in their work to end diaper need by implementing tax credits and tax deductions. Both measures help to incentivize and encourage donations to diaper banks through a reduction in the amount of money that taxpayers who donate applicable items will owe on their taxes for the year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tax credits such as the Diaper Bank Tax Credit in <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=135.621\"><span style=\"font-weight: 400;\">Missouri<\/span><\/a><span style=\"font-weight: 400;\"> directly reduce the amount of taxes that a taxpayer must pay through a dollar-for-dollar deduction. Alternatively, tax deductions such as those available in <\/span><a href=\"https:\/\/mgaleg.maryland.gov\/2024RS\/chapters_noln\/Ch_784_hb0490T.pdf\"><span style=\"font-weight: 400;\">Maryland<\/span><\/a><span style=\"font-weight: 400;\"> reduce the percentage of a taxpayer\u2019s income that is subject to taxes.
